Palace defers exam retake

Executive Secretary Eduardo Ermita said Friday that the government is deferring its action on the retake of the nursing licensure examination until the Court of Appeals acts on a pending petition on the issue.

“We cannot make a final action on the extent of the retake and who should retake because we will look at how the Court of Appeals’ decision will bear on the issue,” he said.

Ermita said Labor Secretary Arturo Brion had been told by Professional Regulations Commission chief Leonor Rosero to wait for the court’s decision on the case filed by nurses who recently took their oaths.

He explained that President Arroyo’s decision earlier this week ordering the 42,000 nursing graduates who took the June examinations to take the test again was meant to save the integrity of the nursing profession.

The President on Thursday announced that she had agreed to allow the retake of Tests 3 and 5 of the examinations.

Ermita said the government would shoulder the expenses to be incurred by the commission for the retake.

P52 million has been allocated for the retake.

If the Palace has to defer the exam retake, Dante Ang has only himself to blame--because he immediately ran to the Court of Appeals and filed an oppositon against the passers!

As stated in earlier comments here in Pinoy BSN, a COMPETENT ADMINISTRATOR TAKES CONTROL OF THE SITUATION. He determines what is right, then act on it. If he is in the Executive Branch, he does not run to the Courts. For as long as he can, he avoids bringing the matter to the Courts because if he does that--he ties his hands, he loses flexibility, he loses his freedom or ability to decide on what to do--because he surrendered the matter to a Court!!! He just has to wait for its decision, and that is uncertain. Depending on the case, litigation can take a lifetime in the Philippines.

That is why in the interview of Dante Ang by Korina Sanchez, he would like to make it appear that the President is not in contempt of the Court of Appeals (CA) because the President was not the one who brought a case before it. What nonsense!

It was not the President, all right, but her alter ego, Dante Ang, a government official of cabinet rank. And the lawyers who argued before the CA categorically stated that they did so in behalf of the Office of the President (to which PRC reports).

As reported, the President will issue an Executive Order on RETAKE. This infringes on rights of passers without due process--nobody among them or their representatives were present in Malacanang to air their side when it was tackled there. Only Dante Ang was explaining, and there was nobody to expose his FALLACIOUS assertions. For example, retake of test 3 is simply WRONG with respect to any passer who got 75 correct answers out of the remaining 80 valid questions in test 3. Not even an Executive Order from the President can nullify the passing in test 3 of that kind of examinees who already earned vested rights on it--if they will fight for their right.

If the matter is in the Courts--and it is--that is contempt of Court because it does not only influences the decision of the Court--it SUBVERTS it if the Court's decision is NO RETAKE!!!

Gusto ko ng retake para matapos na ang gulong ito. Tama na ang debate. Retake na kung retake. Sirang sira na ang credibility ng exam.
