THE GOVERNMENT has no recourse but to administer the professional oath to the nursing graduates who passed the scandal-tainted June 2006 licensure exam once the Court of Appeals order to do so takes effect on Oct. 28.

Justice Secretary Raul Gonzalez said President Gloria Macapagal-Arroyo had made up her mind to obey the CA ruling allowing the oath-taking to proceed even if the Cabinet remained sharply divided on the issue.

Labor Secretary Arturo Brion last week stopped the Professional Regulation Commission (PRC) from administering the oath to the successful examinees pending the end of the investigation into the scandal.

“I’m only avoiding complications that may hinder the closure [of the issue],” Brion said in an interview yesterday.

The appellate court had ordered that all those who took and passed the nursing exam outside Metro Manila and Baguio City and those who had registered for but did not attend the “final coaching” sessions conducted by the three review centers suspected of leaking the test questions be allowed to take their oath as nurses.

Gonzalez said the President was just letting Brion have his way until the CA decision became final on Oct. 28 “out of respect” for the labor secretary. “Pinagbibigyan lang because in the end we have to implement it,” Gonzalez said in an interview with the Inquirer.

There was no point in delaying the oath-taking, he added, because the PRC could easily revoke the licenses of those who might be later found to have cheated.

Gonzalez said Brion’s position was not to allow the oath-taking until all those who had benefited from the leak had been identified.

So far the CA has ordered 1,687 of the 17,821 graduates who passed the exam to retake Tests III (on medical-surgical nursing) and V (psychiatric nursing).

“His (Brion’s) position has always been extreme. He was always for a retake and we had clashed in the Cabinet over that. I said that the nurses were more the victims than the culprits and the real culprits were the nursing board examiners. My position is exactly what the CA did on all four counts,” Gonzalez said.

Brion, for his part, said any moves on the issue would only complicate matters and serve as a stumbling block to the early resolution of the case.

Yes, you did the exam fair and square unfortunately you were not able to pass the NLE. You've passed because of the recomputation and not based on the original result. Indeed, those who were considered as failures in the NLE because of the recomputation are supposedly be the aggraviating parties in this case. You can not blame the PRC in this case it's because the PRC thought that what they've done was right. It's the court of appeals' decision and we have to abide with it. It's so sad to note that you have the license with you now but consider it a blessing on the other side of the coin. Why? The CA has given consideration to the 1,687 to pass the exams again. But by all means everybody should all stand for no retake.

The 2nd post has a point & the 3rd post also has a point. My only advice to the 1,687 who should retake is to have an attorney to let PRC show you how you failed by showing your exam papers & results. While it is true that we are not allowed to see our test papers, if you have doubts, maybe a lawyer can help you with it.

What the CA did was just, it was according to the law. What PRC did by adjusting the passing rate from 73% to 75% may not be acceptable to our law but I & most other examinees believes that you & the others who benifited w/ the adjustment deserved to pass. We must admit, it was a hard exam even for a doctor or even an experienced nurse. We must even thank the PRC for being gracious, not just to our batch but to all other Proffesional examinations held in the past because they always adjust the passing rate up by 2%.

What GMA did to abide by the CA ruling was also just. She may be a useless president but at this point, she abided by the law.

There are few personalities we could blame here and these are:

1) The 2 guilty BON officials
2) Atty: Yangot & supporters for creating a media scandal rather than fighting for it quietly to protect the profession.
3) Dante Ang for being the lying son of bitch that sensationalized the issue to the world with lies he made up to protect his interests.
3) All the media, especially Manila Times & ABS-CBN for their very biased, imbalanced reporting that tainted the profession.
4) UST, Tadle & company who selfishly created rumours to stimulate a movement of RETAKE just to cover the poor performance of their students & their school.
5) UP Dean for publicly insulting all new graduates to the world to selfishly protect not the profession but UP graduates who are mandated by law to serve their country first before migrating.
6) and finally, all others who looked down on this batch of examinees by calling them cheaters & incompetent. You have not an inkling of knowledge to what your accusing us.

Of all the examinees, I can SURELY say that only Dennis Bautista, who took all final coaching from alleged review centers who have leakages, and still failed the exams as INCOMPETENT, a LIAR & & IDIOTIC. That is for sure.

In the end, GOD will always defend what is right.. Not one soul can stop HIS will.

Yangot, Tadle and the other whistle blower are heroes to me....they are the people whose principles are intact and the ones who had the guts or brave enough to stand against a system (the government) who only knows is to rub the people of any wealth.....did you ever wonder why the board exam is so hard and why most of the answer to their question could not be found in the textbook, is because the more examinee fails the higher the price that PRC could sell their leakage.... if you ask me who is the greatest culpit in this dilemma, it rosero, she was able to divide us examinee and use the supposed to be passer to go against people who want to dig out the anomalies of PRC that rosero is involved with and wants to cover up...problem is that the ego of the passer have become so bloated and feel that its their birthright that they have pass the board exam...i ask you this are all of you so sure that you really pass, or baka ginagamit lang kayo as part of their cover up...

To the person who made the second post...dont you get it, I understand and symphatize the humiliation and other mental stress that PRC made you go through.... but on the other side of it, you should be thankful, that you are now given the very BIG change to pass, since you will only be retaking test 3 and 5...guys you have actually failed the june 06 board exam to start with...dapat nga ulitin niyo ang buong exam, like the rest who also failed the exam....

This is were the injustice and inconsistency comes in, why would the court of appeal allow you the 1620 and those who reviewed in the 3 reviewed center to have a retake of only test 3 and 5, where in fact it did not fully recognize that the leak of test 3 and 5 exist.. bakit kayo only test 3 and 5, tapos kami mga grades with 73 below have to retake the entire exam again...it just make me wonder are the court know what is right and what is wrong or what justice really is...or is it just also trying to appeal to the pleasure the majority...

As i remember Brion was tasked by gloria to step into this leakage crisis because rosero started the leakage and could not manage the problem it was causing...so if the professional judgement of brion is for a massive retake and remember gloria herself gave us all the justification why she herself stood by brion decision. why is it now just because CA came up with a inconsisted and quick fix remedy or decision for the problem, instantly made brion a bad guy...brion has the backbone of standing up to what he believe is right...i ask gloria, does she has any principle at all......pasikat lang siya lagi....and by raul gonzales....you are a scum...so you're not worth any effort

yun nga, i have said it many times that lahat tayo biktima dito. Bcoz of PRC irresponsible solutions to the leakage problem, instead of solving the problem mas lalo pa tuloy lumala. passers or not have every right to say what it is in their mind. we are a free country, but some of us (especially the passers)could not withstand but becomes personal in their attacks. anyway, i just wish good luck sa lahat.

I do not think PRC is to blame for the fate of the 1,687 that are for retake...

Paulit-ulit po sinasabi sa inyo na
decision po iyon ng CA that the 1,687 shoud retake Test 3 & 5 based po sa reklamo ng mga taga-UST on recomputation... ayaw po ng UST na magdagdag ang PRC ng .2% initially, yun ang sinabi nila when they filed TRO... pero po ngayon iba na naman ang gusto nila... Gusto nila na lahat ay mag-retake dahil daw lahat daw po ng tests ay may leakage... so malinaw na may ibang dahilan kung bakit dinedelay ng UST ang pagka-resolba ng nursing controversy!

Uulitin po namin...

Anyway, the 1,687 ORIGINALLY did not pass the NLE.

DI PO NATIN PWEDENG SISIHIN ANG PRC DITO. GINAWA PO NILA KUNG ANO ANG TAMA.

Grabe ang saklap naman ng nangyari sa batch june 2006 NLE....Nag take din ako ng nursing kya alam ko feeling nyo kasi lahat naman tayo hinahandga natin mag kalicense kaso problema sa batch nyo may di maganda nangyari pero para sa akin advise ko lang mga dudes ipaglaban nyo right ninyo...Salamat nalang batch 2007 ako sana walang leak na mangyari hehehe sa NLE namin ngayong june 2007 dapat aral nalang tayo mabuti at mag review din ng magreview to pass the NLE at wag natin dayain mga sarili natin be honest dapat tayo kasi buhay ng tao ang nakasalalay dito kailangan magpakatotoo tau... remember life ng tao ang e save natin..para sa batch 2007 na mag take paganahin ang critical thingking ok at sa batch 2006 go go go and fight good luck mga dudes ....
